Release on Own Recognizance is an option that is not always offered to a defendant who has been arrested and is pending trial. Release on Own Recognizance occurs when no bail amount is set and the arrestee is able to leave custody on his or her own recognizance, meaning they themselves ensure, by word, that they will show up to all mandatory court appearances.
Bail amounts, Release on Own Recognizance and denied bail will all be based upon a number of factors:
- The severity of the crime
- Prior criminal convictions for violent or serious crimes
- The "flight risk" of the defendant; the likelihood that he or she will flee after release from custody
- The defendant's ties to the community
- Whether the crime committed was a violent crime
- The likelihood that the defendant's release will endanger witnesses or jury members
