  "Tomato King" released on 6 Million Dollar Bail

I've been in the bail bond business for nearly 15 years now here in southern california, and i have yet to see a 6 million dollar bail bond be granted to a person in custody.  Let alone actually see that person MAKE BAIL.  But that's what happened this past weekend in Sacramento County, as 54 year old Frederick Salyer, the onetime giant of the processed tomato industry is accused of selling products that were old or moldy and of bribing food company employees to gain an upper hand in the market.   Even though prosecutor's of the case have vehemently said they believe Salyer will immediately flee the country to avoid prosecution, the judge allowed the 6 million dollar bail to be posted using Salyer's personal fortune and property to secure the incredible bail amount.  If Salyer does in fact leave the country, the 4 people who agreed to use their homes as collateral against Salyer's court appearance will be in for a very rude awakening.  As is the case with ALL BAIL BONDS, one must be absolutely certain that they believe the person in custody will appear in court and honor their commitment to being punished properly.  I always tell people : "if you have any doubt's about your loved ones cooperation with authority, do not get involved !".   Most of the time people do not have those doubt's and everything goes smooth, but when a person is looking at more than 5 years in prison, all bet's are off !  Here at Dan's bail bonds we take great pride in doing good, honest business.  I think you'll agree.  Hopefully you never have to find out.  Take care, Dan........

  Mass Shooting Suspect Held without Bail

In Buffalo, New York, mass shooting suspect Riccardo McCray is being held without bail.  The decision was made after an indictment by a grand jury.  Recently, McCray pled not guilty to criminal charges.  It took a grand jury three days to review the case presented against him.

McCray was charged with numerous offenses including one count of second-degree murder, three counts of first-degree murder, four counts of first-degree attempted murder and one count of second-degree criminal possession of a weapon. 

Prosecutors overseeing the case say they have sufficient evidence to prove that McCray fled to North Carolina three days after the shooting took place and then returned to New York.  However, McCray is maintaining his innocence at this time.

Terrance McKelvey, McCray's defense attorney, said he is, "adamant about his innocence, he surrendered himself."

Judge DiTullio said that there was, "a material change in circumstances, authorizing a change in bail."  Prior to his indictment, McCray's bail amount was set at $500,000.  Now, no bail has been set.

  People Commonly Misunderstand the Purpose of Bail

In the state of Wisconsin, County Court Commissioner Patricia Koppa is arguing that many member of the public do not understand the purpose of bail.  In fact, Koppa says that most people miss understand what bail is for.

Koppa said, "I think some people look at bail as punishment, but that comes much later."  She went on to state, "It simply ensures someone will come back to court."  Aside from a sure that the defendant will return to court for scheduled proceedings, Koppa asserts the other purpose of bail is to protect the public.

When people must pay bail to secure their release from jail they have numerous options such as cash bail, signature bonds and surety bonds

According to Koppa, bail is like someone's "own good word that someone will show up for their court date."  As long as people make their scheduled court appearances, the money they pay for bail will be returned to them. The only time bail money is not returned is when people do not show up in court.

  "Cash Bail" can be a double-edged sword !!

I recently was involved in a bail bond negotiation with a very wealthy man who wanted to bail his son out of jail on felony hit and run, DUI and drug possession charges.  Obviously, this young man had some "issues".  The total bail for him was set at 80,000 dollars and the dad wanted to know if he could put the 80 grand up himself, in full !  He asked me if he could do that, and unfortunately for me, he could, thus bypassing the need for my services and fully securing the bail with cash.  Hence the name: "Cash Bail".  I advised the dad that it could "backfire" because the judge and the prosecutors in the case will know that he did such a thing because it is on the court record.  By doing this , the dad risks bias and prejudice from those who will judge his son.  Inherently, as a society, we tend to look at people "with money" as favored or receiving "special treatment" and this could greatly alter the punishment that he will ultimately receive.  Not to mention the fact that once you put your own money up to bail someone out of jail, there is a chance that any fee's or penalties or judgements will ultimately be taken OUT OF THAT MONEY.   This kid was facing potential lawsuits from the car he hit and the people he injured, not to mention the street light he destroyed.  By putting up his own money he was exposing himself to unnecessary risk.  Most times it's prudent to just pay the bail bondsman his 10% fee and keep your money "quiet" !   Any criminal defense lawyer will tell you the same thing.  Give me a call to talk about any legal related issue, i'm always open.  By the way, he didn't listen to me.  You can lead a....

  Bail Solicitation fraud continues to get worse

If your a consumer looking for bail bond information and you happen to be lucky enough to be reading my blog, please be aware of the rampant and illegal bail solicitation that is taking place in today's "digital age" !!  Because of the internet and the fact that a person's arrest information is made public shortly after they have been arrested and booked into custody, unethical and slimy bail agents are "cold-calling" people UNSOLICITED pretending to be interested in "helping you" !   BUYER BEWARE is all i can say.  These bail agents obviously give my industry a bad name and cause good families a lot of problems they don't need during a time when  they could really use GOOD , HONEST professional assistance.  Very few people have ever had to negotiate a bail bond and contact a bail bondsman for advice, and these unscrupulous agents are preying on that lack of experience.  Here in Los Angeles there must be thousands of bail agents and only a small percentage "play by the rules".  This is so important to know because these rogue bail agent's can get you to pay far more than you should pay by law for your loved one's bail fee's !!   If you are contacted at home by a person claiming to be a "bail agent" who want's to "help you" bail your loved one out, please take their name and # and contact local authorities (or just call me and i'll report them for you).  And remember, a bail bond cost's 10% of the bail amount and discounts to 8% are allowed by law.  Know the rules.  Know the law and know your right's !!  I'm Dan Nesser from Dan's Bail Bonds and i'd like to help YOU.

  Former Enron Corp. President Denied Bail

On Friday, a federal appellate court judge turned down a bail request for former Enron Corp. President Jeffrey Skilling.  The request for bail was pending the ongoing judicial review of his conspiracy and fraud conviction in 2006.  At this time, Skilling is serving a 24 year prison sentence for the federal crimes he committed.

Skilling's recent bail effort followed a favorable Supreme Court decision in the month of June.  At that time, the court found that one of the theories under which Skilling was prosecuted, known as "honest services" fraud, was in properly utilized by federal prosecutors.  The court ordered that Skilling's case be re-reviewed by the Fifth Circuit Court of Appeals to determine if his prior conviction on 19 criminal offenses should be vacated or modified.  This matter is still pending with the appeals court.

The defense attorneys representing Skilling are arguing that the entire conviction should be overturned due to the recent decision by the Supreme Court.  However, the Justice Department is asserting that the use of the honest services statute was an error, but a "harmless" error.  They say there was sufficient evidence for the jury to convict Skilling for other criminal offenses, such as securities fraud.

Last week, despite arguments, the bail denial was handed down by Judge Edward C. Prado and the judge did not provide any explanation for his decision.

  Collateral Bail Bonds Explained

  $1 Million Bail Set for Man who Kidnapped His Ex-Wife

The Associated Press reports that a Connecticut man that was charged with kidnapping and stabbing his ex-wife before leading authorities on a 50 mile police chase on the Massachusetts Turnpike was ordered to be held on $1 million bail.  The bail amount was ordered after an angry outcry in court.

39-year-old Eric Stiggle, a New London resident, yelled at a Superior Court judge and also struggled with judicial marshals this week Monday.  Judge Jane Emons decided to set the high bail and set a court date for the case.  Stiggle has been formally charged with assault and kidnapping, which is a federal crime.

According to authorities, on May 30th, Stiggle forced his ex-wife into her car and then proceeded to choke and stabbed her.  The kidnapping ended the next day when he crashed the car during a chase with police.

At this time, it has been revealed that the woman is still recovering from her injuries.

  Who Usually Applies for a Bail Bond?

  Prosecutors Disturbed by Lower Bail Amount for 1978 Murder Case Suspect

This week, it is reported that 57-year-old Lee Evans was released on Saturday after his family posted $950,000 bail.  Evans is the suspect for the murders of five teens that were burned to death inside an abandoned house in Newark back in 1978.

Reporters say that Evans said nothing as he left the Essex County Correctional Facility.  He was freed during evening hours on Friday just one day after the anniversary of the August afternoon that the teens had vanished.  Police investigating the case remained confused for decades.

County prosecutor, Roberto Laurino, said that the bail reduction in the case was very "disturbing".  Originally, Evans bail was set at $1.25 million in March and was later reduced. Evans and his cousin, 53 year old Philander Hampton, were indicted in July for the charges of murder and arson involving the deaths of the five teenagers.

Police say that because of the lured the teenage boys into the back of Evans' pickup truck by promising them paid jobs. Instead, authorities say the two men forced the victims at gunpoint into the abandoned house and then locked the victims inside and burned the house to the ground.

Evans was arrested on March 22nd after confessing to police and implicating his cousin, who remains in jail on $5 million bail.

  BEWARE the unsolicited Bondsman !!

One of the BIGGEST problems facing the Bail Bond Industry today is the amount of fraud that is taking place among competing bail agents.   By law, we are not allowed to contact the family or loved ones of someone who has been arrested, yet this is exactly what some agents are doing.  Thanks to the internet and the fact that arrest information is made "public" online, unscrupulous bail agents are "cold calling" the homes of these people and soliciting their "services" without the family realizing that their loved one DID NOT give them their phone # to begin with.   This illegal, and unethical, practice is happening all day, everyday.   And by doing business with "businessmen" like this you could be exposing yourself to even more problems than just trying to help someone get out of jail.   For instance, avoid doing business with someone who has broken the law in the first place to get your business !  If the judge were to find out, he could void the bail and put your loved one back into custody, only to have to re-bail again.  Not to mention the financial terms of the bond deal, which could wind up costing you MORE than the law allows to charge.  Think about it: if a bail agent breaks the law to win your business, then what do you think the rest of the relationship is going to be like ?  Regrettable, that's what it will be like.  A bail bond is an important legal contract that requires a proven, reputable bail agent who can professionally explain the cost and all your rights by law.  You deserve nothing less than that.   Please give me a call anytime.   Dan Nesser

  What Happens after a Person is Arrested?

Many people often wonder what happens after a person has been arrested for a criminal offense in Los Angeles. After a person has been arrested in LA County, they'll be taken to the closest police station for processing and booking.  Usually, the processing and booking procedures take a great deal of time unless the jail facility is small.

Once an individual has been booked at the jail, one of three things will happen.  First, the person may be released without any charges being filed.  Second, a bail arraignment will be set by the jail or the court. During the arraignment, a judge will determine the amount of bail if any and the person will have to make arrangements to pay bail if they want to be released from jail.  Third, the person may be released on his or her own recognizance.

With the second option, many people cannot afford to pay the total bail amount already. In these situations, a criminal bail bond may be the best solution.

  Child Molestor Held in Lieu of Federal Bail

This week, a man who was wanted by federal agents for imprisoning a child and attempting to molest her at a Pasadena motel has been apprehended in Mexico with help from the US marshals and Mexican national police.

48-year-old Robert James Ruiz was caught and arrested last week by Pasadena police officers. He was arrested for false imprisonment and attempted child molestation.  Police say that he held an underage female against her will on July 29th in a hotel room and tried to molest her.  The girl's age has not been made public.

After Ruiz learned he was wanted by police, he fled to Mexico where he was later arrested without incident.  Detective Lt. Tracey Ibarra of the Pasadena Police Department said, "Mr. Ruiz had an association with the victim's family and took advantage of this relationship."

Formal charges have been filed against Ruiz by the Los Angeles County district attorney's office and his charges include lewd acts with a minor, child abuse and indecent exposure toward a minor.  He is currently being held in lieu of $1.2 million bail.

  Maine Man Being Held for Breach of Bail Charges

News sources in Maine say that a jogger who was banned from the Portsmouth community after yelling profanity at police and local residents is currently being held on $1,500 cash bail and $2,000 personal recognizance bail.  His arrest them from new charges alleging that he threatened a witness at his Tuesday trial.

49-year-old Craig O'Brien appeared in Portsmouth District Court this week via a video from the Rockingham County House of Corrections.  He is facing a felony witness tampering count as well as a Class A misdemeanor charge of criminal threatening.  He has also been charged with misdemeanor counts of breach of bail.

Police report that O'Brien was out on bail and in trial Tuesday for two disorderly conduct charges when he allegedly threatened a witness who was being sequestered in a hallway area at the Portsmouth District Court.  He supposedly told the witness, "You are dead."

  Deputies urges to use discretion in arrests

A Los Angeles County sheriff's lieutenant recently sent an internal memo to deputies in Norwalk encouraging them to consider an individual's past and career potential before making a felony arrest !!  In the memo, Lt. Bill Evans offers the hypothetical example of a student "who seems like a decent kid" from Biola Christian school, being caught with an illegal folding pocket knife.  "Are you really going to put a felony on this guy...." reads the e-mail.  "Here is a kid that could have been planning on going into the military, being a cop or fireman, and/or just being a guy with a career."   The memo, as reported by the Los Angeles Times , offers an inside look at the challenges deputies face in balancing the need for efficient policing while avoiding bias in arrests, law enforcement experts say.  And there in lies the "rub", as they say.  Discretion in policing is a "two-edged sword" and i have been advocating for YEARS that the police department needs to spend as much time training deputies to understand this balancing act much, much better.  Isn't it just as important to write a good police report as it is to fire a weapon ?   In fact, it may be MORE important to teach "sensitivity training" to new deputies than it is anything else.  I am a Los Angeles bail bond agent and i have seen the very worst that this city has to offer , as well as the very best, and i believe that making better "judgement calls" by deputies is the very first step to correcting all that is wrong in the arresting process !  Hey, i want to be a successful bail bondsman, just not at an innocent individuals expense !!  Give me a call anytime for free bail info.   Thanks, Dan

  WWE's DIV Tiffany Posts $20,000 Bail after Domestic Disturbance Arrest

This week, it has been reported that WWE Diva Tiffany has been suspended after being arrested.

Last week Friday, Diva Tiffany (real name Taryn Terrell) was placed under arrest by Los Angeles police officers.  According to reports, or arrest stemmed from a domestic disturbance between her and her husband Drew McIntyre of smack down. The incident took place at a hotel they were staying in. Immediately following her arrest, she was suspended by the WWE.

The row was charged with a misdemeanor against McIntyre and was taken into police custody early Sunday morning.  Sunday afternoon, she was released after posting $20,000 bail.

The WWE has described her suspension as "indefinite" said pwinsider.com.

  Police Chief Charged with DWI and Released on Personal Recognizance Bond

In the city of Austin, it was recently reported that the police chief in Bastrop was charged with driving while inotxicated (DWI) following his traffic stop and arrest.

Police say that Chief David Board was stopped by officers this Monday night.

According to Travis County Sheriff's spokesman Roger Wade, Board was charged with misdemeanor driving while intoxicated. However, he was later released on a $5,000 personal recognizance bond.

Bastrop City Manager Mike Talbot says that in place of Board, Assistant Chief Matt Wagner will assume the police chief's duties while he addresses personal matters.

Board would not comment on his charges when asked questions by the Associated Press.  Yet his photo and welcome message remain on the police department's website.

  16 Year Old Held without Bail for Murder Charges

In Lancaster, California, a boy that is 16 years of age is being held without bail after being accused of fatally stabbing his 11 year old cousin.  He also stands accused of harming the cousin's 14 year old sister.  Police say that the assault took place inside of the cousins' home, which is north of Los Angeles.

On Thursday of last week, the Los Angeles County district attorney's office charged Lonnie Liner as an adult for charges of murder as well as attempted murder. He was placed under arrest after authorities found him in a nearby junk yard.

Police say that the 11 year old died from slash wounds to her throat inside of her home and her sister suffered numerous stab injuries, but managed to escape Liner.

If he is convicted, Liner will face two life terms in prison.

  Kenneth Starr Released on $10 Million Bail Bond

In the state of New York, a staggering $10 million bail amount has been set for Kenneth Starr, a prominent financial advisor that stands accused of defrauding his celebrity clients and investors out of $59 million.  Some of his more well-known clients include Wesley Snipes and Martin Scorsese.

Since May, Starr has been in police custody for fraud and related charges.  Originally, he was hoping to be released on $2 million bail and pled guilty to his criminal charges. 

This Tuesday, U.S. District Judge Shira A. Scheindlin received a criminal bail bond in the amount of $10 million, which was co-signed by Starr's two brothers, a friend and his wife.  After his release, Starr will have to adhere to home detention terms and also wear an electronic monitoring device.   

According to federal prosecutors, Starr stole approximately $28 million from his clients' bank accounts and used the money for personal purchases.  He also stands accused of soliciting $29 million from clients which was diverted to risky, liquid investments in which he and others held financial interest.

Under federal sentencing guidelines, Starr could serve life imprisonment if he is convicted.

  JetBlue Flight Attendant Posts Bail, Gets Released

This week, after he got into a confrontation with a passenger and quit his job, Steven Slater walked out of jail after posting $2,500 bail.  Slater, formerly a JetBlue flight attendant, garnered national attention after he dramatically resigned his position with the airline.

New York Department of Correction spokesman Stephen Morello did not have any details on who posted Slater's bail.

At this time, JetBlue has said that Slater had not been removed from duty as they are investigating.  On Monday, Slater cursed at the passengers on an aircraft over an intercom, grabbed a beer and then exited the plane by deploying the emergency slide.  Reports indicate that when he made his court appearance, he has a smile on his face.

  Getting an Order of Protection for Domestic Violence

When people plan to obtain orders of protection because they have been subjected to domestic violence, domestic abuse, stalking or harassment, they will need to meet two requirements.  First, they will have to have a certain type of relationship with the person they plan to file the order against (defendant).  People can obtain orders of protection against their:  current or former spouses, people they lived with, people they have children with, relatives, family members and people they have had intimate relationships with.

Second, people must be able to prove that they were victims of domestic violence.  For example, if a person was physically, emotionally or sexually abused by a person that he or she was in a relationship with, it would be categorized as domestic violence.  People may also seek orders of protection on behalf of their abused children.

  ACLU rips conditions at Mens Central Jail

The American Civil Liberties Union, or "ACLU", as it's commonly known, blasted the "horrific conditions and abuses" at the Men's Central Jail in downtown Los Angeles after a report 2 weeks ago exposed a system used by a group of deputies there to avoid making routine checks on inmates' welfare.   A March 2009 suicide prompted an investigation, which revealed that an inmate had been dead for hours before his body was found, despite records appearing to show that a deputy had passed the man's cell while he was dead.   This stunning revelation has touched off a firestorm of outrage and frustration.  Just when it didn't seem that the Los Angeles County Jail system could get any worse or irresponsible, it DOES.  I always tell people when they call me for bail bond information: " if you can afford to bail your loved one out of jail, DO IT" .  Because who wants to have their loved one being "looked after" by incompetents like this ?   And yet, the sheriff still has press conferences telling the public just how well his jail is run, etc.....   When Can Bail be Denied?

Under the Bail Reform Act of 1996, every defendant has the right to bail unless there is a good reason.  All people who commit crimes are innocent until they are proven guilty, which is why bail should not be denied unless the decision is justifiable because it would impinge upon people's freedom.

However, despite defendants' rights, there are legitimate times when the court may refuse to order bail.  The main reasons for refusing bail after a defendant is accused of an imprisonable offense are:

§  having legitimate grounds that a defendant would flee

§  having legitimate grounds that a defendant would commit crimes if he or she was released

§  having legitimate grounds that a defendant would interfere with witnesses for his or her case

Before deciding whether or not a defendant is eligible for criminal bail, the court will consider:  the crimes the defendant is accused of committing, the severity of the crimes, the defendant's character with the community, the defendant's criminal history and bail record and the strength of the evidence presented against the defendant.

  Paying for Bail: Your Options

If you have been charged with a criminal act, you will either be released on your own recognizance if you are not a flight risk, have to pay bail or not be eligible for bail.  Should a judge grant you bail, you will need to figure out how you will secure your release by paying the set bail amount.

Generally, there are two ways in which you can pay your bail.  First, you can pay the full amount of the bail with cash or a personal check.  Second, you can obtain a criminal bail bond.  When you obtain a bail bond, you pay a bond agent to post a bond with the court.  The court then holds onto the bond until you make all scheduled court appearances.  Usually, you can obtain a bail bond by agreeing to pay a bail agent around 10% of your total bail.  You must pay this fee because the bail agent is taking a risk as you may fail to appear in court - costing the bail agent money.

  Surburban Mom Seeking $700,000 Bail Bond

In Philadelphia, Pennsylvania, a mom from the suburbs is now seeking a criminal bail bond in a $700,000 fraud case.   In the summer of 2009, Bonnie Sweeten had blamed her staged disappearance on two black men.  Since calling 911 and making a false report of carjacking and kidnapping, Sweeten has spent a year in jail.

After calling for help and making false allegations, authorities say that they found Sweeten and her daughter a few days later at Disney World and believe that she fled to avoid a fraud investigation.  Sweeten worked as a paralegal and allegedly stole from family members, law firm clients and other individuals to live beyond her means.

Police say that Sweeten served a year in county prison and is now in federal custody due to her fraud case.  Prosecutors have asserted that Sweeten has proven she is a flight risk and should not be eligible for bail.

  Bail Restrictions in the U.S.

People who have found themselves in trouble with the law and who have been arrested commonly wonder if there are restrictions on bail amounts.  According to the U.S. Constitution's Eight Amendment, bail cannot be excessive.  You may be thinking, "What does that mean?"

Essentially, it means that when deciding upon bail, a judge should not try to raise money for the government or try to punish a person that is suspected of committing a crime.  After all, people are presumed innocent until proven guilty and should not be subjected to unfair treatment during the legal process.

  Posting Bail: What Does it Mean?

In the United States, bail is essentially cash or cash equivalent that a person that has been charged with a crime (defendant) will give to the court to ensure that he or she will make scheduled court appearances.  If the defendant makes all of his or her court appearances, the court refunds the total bail amount.  However, if the defendant fails to appear in court, an arrest warrant will be issues and the court will keep the bail.  Bail amounts can be set for both criminal and federal crimes.

Bail can be paid by defendants in several ways:

§  through cash or check

§  through property that is worth the full amount of bail

§  through a criminal bail bond or federal bail bond

§  through a waiver of payment, also known as release on one's own recognizance

  Mexican Official Denied Bail for Conspiracy Charges

In San Diego, it is reported that a U.S. judge has denied federal bail for a Mexican official that stands accused of sharing private U.S. law enforcement information with a drug gang in Tijuana. 

Jesus Quinonez Marquez pled guilty to charges of federal conspiracy and racketeering.  The judge presiding over his case ordered that Marquez be held without bail until his trial. 

Last month, an international partnership in the Baja California attorney general's office resulted in 42 people being charged with crimes such as:  conspiracy, murder, kidnapping, drug smuggling and money laundering.  All of these offenses are classified as federal crimes.

Investigators say they were able to capture evidence against Marquez by wire tapping his cell phone and recording conversations.

  Holy Smokes would this be something

Pope Benedict XVI is a head of state and the leader of more than a billion Roman Catholics worldwide.  To Jeff Anderson, a lawyer who represents victims of sexual abuse by priests, he is also a potential legal witness.  Unlikely as it may seem, Anderson intends to demand the Pope's testimony in a sexual abuse case wending its way thru the Oregon court system.   This couldn't make me happier.  For years i have been demanding that the Pope and other Catholic Church "bigshots" like Cardinal Roger Mahoney of Los Angeles be taken to task for harboring convicted sexual predators like they do in their "churches".   Of course, the church fights back claiming that it is immune from the U.S. Legal system, which it is to some degree.  However, nobody seems to be pushing hard enough (or loud enough) to demand the Pope testify regarding the thousands of sexual predators who masquerade as priests in Catholic Churches worldwide !!!   Can you imagine THAT bail bond ?   Im not sure if collateral would be required, but i have never put a lien on Vatican property before, to say the least !!   Congrats to Jeff Anderson, and righteous lawyers like him, who do not subscribe to the rule that "church and state" have different rules.   I hope his voice gets louder and louder and the victims of sexual abuse get what they deserve MUCH MORE than money: a personal apology from the Pope himself and all guilty predators who committed such sins.   Good luck with that and may God Bless all of us !!!

  Would 500 Thread Count Sheets Work ?

A recent story coming out of our horrible Los Angeles County Jails concerns the use of sub-par linens that inmates are using to hang themselves.  Jail-issued mattresses and blankets designed to prevent suicides have failed repeatedly to meet their safety goals, as several Los Angeles County inmates have been able to fashion nooses from their inferior bedding.   Department officials say inmates chew at the blankets and sheets lined stiching and work them until they give, thus allowing them to be torn into strips used for suicide by hanging.   This issue poses many problems, not least of which are the lawsuits that the County of Los Angeles must ultimately deal with as a result of their "negligence".   Due to the intense budget crisis facing this County, and State, officials have been forced to buy the cheaper alternative bedding which is literally being ripped to shread's.   Sheriff's department spokesman say that every time they come up with an alternative or "solution" to the problem the inmates figure out how to beat it.  Which really proves that the police department is always playing catch-up against the ingenuity of a criminal.  In my time as a bail bond agent here in Los Angeles, i've never had a concerned family member ask me if the sheets at the jail were "up to par" to prevent suicide.

  Rogue Bondsman arrested in Orange County

Making recent bail news out of Orange County last week, local bail bondsman Ronald Lee Brockway, 50, was arrested by local sheriff's department officers for running an illegal bail bond referral scheme. Brockway allegedly solicited attorney referrals and inmate business with "kickbacks", "favors" and illegal professional conduct.   The bail bond industry is apart of the massive Insurance industry, and essentially we as bail bondsman are "insurance salesman".  The bonds we sell are really insurance policies, and the 10% fee we charge is called the "premium".   The violations that Mr. Brockway is accused of committing undermine the entire industry as a whole.  His illegal business practices not only give the bail industry a bad name, but alters the "competitive playing fields" business-wise.   Ironic that this bail bondsman needed to call his own office to bail him out!  How embarrassing.   But this guy needs to have his license revoked and suspended permanently  for the felonies he's committed.   Hopefully, he won't come into YOUR line of work.

  This is no "Fish Story"

A recent story caught my eye in the paper the other day.  Two Los Angeles area men were charged with catching a rare giant black sea bass off the Balboa Pier in Newport Beach.   The fish they hauled in measured 62 inches long and weighed 185 pounds !!   WOW.   In case you didn't know, black sea basses are listed as critically endangered species in California.   Apparently, the 2 men struggled with the fish after hooking it on their fishing lines.  The scene was so intense that many people started filming it with their cellphones.  That's how the Orange County district attorney's office found out about it !  Talk about the digital age !!    Both men are scheduled to be arraigned July 16th in Orange County court, and i will be there in case the judge sets bail and orders these men to face further legal prosecution.  It's difficult to say if they are at fault here, as i don't believe they knew what they had.  But the Department of Fish and Game is no different from the Department of Motor Vehicles: wanna drive- need a license.  Wanna fish- need a license for that too.  And the knowledge that if you have something that big and intense on your fishing line cast from the pier, then just cut the damn line !!!  In all my years of doing bail bonds in Los Angeles and Orange counties, this story is a first.

  The Grass is not always Greener.....

A recent story regarding the new downtown Los Angeles Police Department caught my attention the other day.  It does not have to do with bail bonds or public policy or a demonstration, but rather, with grass.  Thats right : Grass.  And i don't mean medical marijuana, either.   The new police department located downtown at the corner of 2nd and Spring streets is an absolutely marvelous facility, except for the acre size patch of dirt that now sits there like the saharan desert.  Initially, this parcel of grass was warmly embraced by downtown loft dwellers who desperately need a little green grass for their dog's to feel "normal on".  However, since opening ceremonies 3 months ago in February, the police department has not maintained this luscious acre of green, and now it is simply dirt.   And it is more than just an eyesore, it is causing an uproar amongst tax payers who have been crying out for YEARS that downtown L.A. lacks any green parks for gathering personally as well as for their pet's to have a place to pee.  The estimated cost of installing, and maintaining, this grass is 14 grand.  City Hall has agreed to repair the dirt lot and bring it back to it's original beauty.  And not a moment too soon, with summer heating up and the need for pet owners to have someplace for their animals.  I just wish that the police would arrest dog owners who allow their pet's to #2 on the street and then not pick it up and dispose of it properly !!  I'd love to do those bail bonds !!

  When the price quote you hear sounds too good to be true......

.......it probably is !!  I received a phone call yesterday from a recent bail bond customer who did not use my services.  They had used another bail bondsman who quoted them a much lower (and illegal) price.  The husband wanted to see if he could "get off the bond" with the other bondsman and use me now, instead !!  I asked him "why did he want to do that ? ",  and he replied: "because the bondsman they had hired was threatening to re-arrest their loved one for failing to pay the balance quickly enough" !!  In this families haste and desperate desire to bail out their daughter very quickly (and cheaply), they ended up making a costly mistake by not reading the "fine print" in this particular bondsman contracts.  These "sneaky" clauses allow the unscrupulous bail bondsman to take advantage of naive and hasty customers who are usually so overwhelmed with emotion that they cannot see clearly.  Stories such as these exist EVERYDAY in my industry, so it's really no different than Wall Street .  It's buyer beware out there folks, and the cost of a bail bond in California today is 10% of the bond value.  So if your looking for a 50 thousand dollar bail bond, that will cost you 5 grand.   There is one legal discount allowed by the California Department of Insurance, and that is the 8% rate given to those who have retained a criminal defense lawyer for their defense or the fact that you are an active union member here in California.  For more details and to find some good, solid answers to all your bail related questions, please give my office a call.   Thanks, Dan Nesser......

  Ontario couple slapped with 225 Million Dollar Bail !!!

A recent bail case definitely catching my attention recently was the 225 MILLION DOLLAR BAIL set by a San Bernardino Judge.  150 million for the husband and 75 million for the wife !!  Their crimes?  Apparently, they sold all-terrain vehicles without California smog certificates.  In addition, federal customs authorities are investigating this Chinese couple with money laundering and grand theft.  But the main charge is that they are selling all-terrain vehicles with engines that have never been certified by the California Air Resources Board.  A very big NO-NO, to say the least.  But 225 million !!??   Wow, is all i can say.   This is far and away the highest bail ever set in California, and possibly the nation.  The rational for the decision has not been made perfectly clear by the Rancho Cucamonga Superior Court judge who set the bail, but all involved with the case agree he is sending a message:  Don't think about defrauding our environment.  It's too bad the Obama administration doesn't take the same stance with those assholes from BP and other "big oil companies".

  BEWARE of the "Annual Bond Renewal Fee"

I recently received a call from a gentleman here in Los Angeles who was already out on bail with another bail bond company.  His case was nearing the 12 month period and he was rudely informed that he would have to pay for his bail bond again, or face being re-arrested !!  This is called an "annual renewal fee", and for those unscrupulous bail agencies who charge this unethical fee all i can say is : "bad karma's a bitch".  So for someone who has already paid their 10% premium bail fee once, you can see why there's going to be anger when asked to pay for it a second time without even knowing this fee was going to be charged again.  We here at Dan's Bail Bonds do not charge an annual renewal fee.  Pay once, and no matter how long your case runs on for, you do not have to pay for it again.  I also offer free bail information 24 hours a day, and my information is always based on what's in YOUR best interest.  Not mine !  My philosophy is "by advising you on the financial aspect of your bail bond decision FIRST, and the emotional aspect SECOND, we can make a prudent decision together.  This is how good business is done.  Here in california, we write the most expensive bail bonds in the country, so theres enough money made by the bail company originally without having to make more if the case goes past one year.  So please, if your going to bail out of jail with another company other than Dan's Bail Bonds, please ask if they charge an annual renewal fee first, before it's too late.  Be careful, it's a jungle out there.

  Iranian Movie Director Freed on Bail

In an interesting story in today's news, Iran has freed internationally renowned film maker Jafar Panahi on 200 thousand dollar bail.  Panahi, who has won top awards at the world's biggest film festival's, reportedly was very outspoken against last years Iranian elections that were allegedly "rigged" to ensure that Iranian President Mahmoud Ahmadinejad won.  Which he did.   Panahi was put into Iranian custody after police there raided his Tehran home looking for evidence that the director was engaged in "anti-government" propaganda.  This story was surprising to me on a couple levels.  First, i was not aware that bail was even offered in Iran, and second; the fact that Panahi was arrested without his charges being made officially known !!  This is not how it works here in America, where charges made against an individual MUST be declared before arrest.  Many people are unaware that the opportunity to "make bail" is a constitutional right that we all "enjoy".  To protest his unfair arrest, Panahi has been on a hunger strike until he was allowed to see his family and speak with a lawyer, things that are guaranteed to defendants in this country as well.  This bail bond related case is another example of how well democracy works.  Love it or hate it, one cannot deny the right's that we all MUST have in order to be regarded as a "modern society".  Iran, i believe, is still living in the "dark ages", as this man's situation clearly illustrates.  Another famous director has made bail bond news lately as well, but Roman Polanski and Jafar Panahi could not be any more different !!

  Why following up on Warrants is so IMPORTANT

One of the most common forms of bail bonds i do here in Los Angeles County, and southern california in general,  are  regarding "old warrants".   People, just like you, who have already gone to court for their "issue's", yet failed to complete ALL the court ordered requirements.  These requirements can range from fines that need to be paid all the way to DUI classes or anger management classes, etc....For example, if the court orders someone to attend 12 anger mgmt classes, and this person only attends 11, there will be a warrant issued for their arrest !  That's right, failure to fully complete any court-ordered requirement subjects that person to being arrested AGAIN and having to bail out of jail AGAIN.  As a bail bondsman, i love the business, but i hate to see good people who have honestly tried to honor their sentence get re-arrested due to something so minor.   However, these are the rules with which society is designed and it is imperative that we see it thru to the very end.  I have many recent bail cases where the examples i just laid out have come true.  In fact, warrant's account for 30% of my business !   So if you feel you may have an outstanding warrant for your arrest, please feel free to give me a call.  I offer FREE bail information 24 hours a day.  I can check with the court that you had an arrest out of and verify if you have more "work to do".  In fact, by contacting my bail office you can prevent having to be re-arrested and forced to pay the bail fee's ALL OVER AGAIN.   If you suspect anything, call me, you'll be glad you did.   Dan......

  Lindsay survives the Judge

Following up on my recent blogs concerning the Lindsay Lohan case, today was the day Ms. Lohan saw the Beverly Hills Superior Court Judge who postponed her vacation just so she could be present to admonish the 23 year old "celebrity".   Turns out the judge's bark is far worse than her bite.  Despite arriving late to court, Lohan and her attorney basically went thru the motions.  Lohan was advised of her strict "bail rules" while free on a 100 thousand dollar bond.  Those rules included no alcohol consumption and mandatory weekly alcoholics anonymous meetings, as opposed to the daily meetings Lohan had requested.  The judge thought that was a bit "too aggressive" , and sensed it was simply a request to complete the beneficial classes in a hurry just to "move past" her legal issues.  Lohan appeared disinterested and aloof during the televised court appearance this monday morning.  It was interesting to hear the judge repeatedly refer to her "bail rules" during open court, as this is typically not the manner in which a judge reminds their defendants about proper behavior regarding their respective legal concerns.  I imagine she did this to deflect from her own courtroom rules and to give Lohan the idea that it is not actually the court that's watching her behavior, but society itself.  Of all the celebrity bail and legal cases that make news every month, this one seems to have hit a nerve with the public.  And why?  I suspect because of the same reason we all slow down to look at an accident when we drive by, America loves a train wreck !

A celebrity bail case involving actress Lindsay Lohan continues to gather steam after the actress decided to skip last weeks mandatory appearance in Beverly Hills Superior Court to instead attend the exotic Cannes Film Festival in France.  This decision by the actress infuriated the female judge who is presiding over the case.  So the judge decided to postpone her previously scheduled vacation plans so she can be there to personally admonish the 23 year old star.  Lohan is answering to probation violations stemming from her 2007 DUI arrest.  She must prove to the court that she is adhering to strict codes of conduct regarding her sobriety and drug abuse.  I wouldn't be surprised if the judge orders Lohan back into custody, despite already allowing her attorney to post bail for Lohan in lieu of issuing a felony bench warrant last week.  By granting Lohan this "break", the judge is insuring that Lohan make it thru international customs and into her courtroom Monday.  I have rarely seen a judge do something like this, especially for something as unimportant as this.  This is why i believe the Judge may have a very rude awakening for the troubled and irresponsible former child star.  This case has not just made the Los Angeles area news, but world news as well, no doubt fueled by our crazed TMZ culture.   And the issue of her bail being set at 100, 000 dollars has also raised eyebrows as well (why so high ?).  A lot of questions regarding the judge's agenda will be answered Monday morning.  The world awaits with baited breath !!  Oil spill ?   Lindsay Lohan is up to her "Old Tricks" again

Looks like the poster child for celebrity's gone wild, Ms. Lindsay Lohan,  is up to her usual defiant behavior yet again.  Lohan has made news recently for failing to appear in Beverly Hills Superior Court on thursday regarding a mandatory appearance from her 2007 DUI.  Lohan had an arrest warrant for 100,000 dollars issued against her, only to have that warrant recalled once the 100k bail was posted on her behalf.  Unfortunately, i was not the bail bondsman to post this bail, but i have had the "pleasure" of doing some celebrity bail in my day.  I like to deal with celebrities because they usually have money to pay for the bail fee's and they can afford to hire a criminal attorney to help represent their interest's.  I also am reminded that celebrities are just like the rest of us, minus the "rich and famous" part.   It's good to see the court be stern with Lindsay Lohan, as it sends a positive message that regardless of "who you are (or think you are)", you will not be treated any differently.  Lohan has a history of drug and alcohol issues that have made her more famous for those issues rather than her acting skills.  As a Los Angeles area bail bondsman, it's almost impossible not to get involved with a celebrity client from time to time.  What is unusual is seeing someone who continuously "screws up" like Lohan does time and time again.  By choosing to remain at the famous Cannes Film Festival to promote a movie rather than be here in Los Angeles to honor a mandatory court date, most of us will not shed a tear if Lohan find's herself in handcuffs once she gets back home.  Besides, I never liked her movies anyway !  (just kidding Lindsay)

  What EXACTLY is a Bail Bond ?

Sometimes in the bail bonds business, a client who has hired me to post bail for a loved one will ask : "what is it we're buying dan" ?  And i will answer : " you are buying an insurance policy, and the 10 % fee that you are paying me is called the premium".  This premium is non-refundable.  I have to be very clear in explaining this because many people think they get their money back once their loved one goes to court and answers to the charges against them.  That is false.  The 10% fee that is paid to the bondsman is not returned, as this is how the bail agent makes his/her living.  When the defendant we've bailed out of jail goes to each and every court date and honors their contract in full, then the respective court will then return the bail bond that i posted on their behalf back to me.  Once this "exoneration of bail" happens, the relationship between myself (the bail bondsman) and the defendant i've bailed out is over.  Unless of course there is still money owed, and in that case i would retain any collateral that may have been used in the transaction until all debt's have been paid.  The bail bond process is effectively a "short-term loan", and the relationship between bondsman and defendant only exists from the time of bail until sentencing against the defendant.  Sometimes a case will last only 2 weeks, and sometimes as long as 3 years due to lawyers litigating it out for strategic purposes.  I enjoy helping people who have questions about my business.  I like to help good people who have simply made mistakes in society.  Compassion is a big part of what i do, not all the time, but most of the time.  Be safe...........DN.

  Downtown Los Angeles County Jail is no Picnic

Recent news stories on local television and in the Los Angeles Times are reporting that dozens of inmates at Los Angeles County's Men's Central Jail have alleged serious physical abuse by deputies, including: broken ribs, black eyes and head wounds that needed to be sewn up.  These allegations are being made by the American Civil Liberties Union or "ACLU" as it is commonly known.  The extent of the abuse is impossible to gauge, but i can say from experience that these allegations are probably all true !  Even I, as a Los Angeles Bail Bondsman, have to be very careful to make sure that i don't physically harm the fugitives i'm paid to hunt down and apprehend.  Why ? Because criminals have rights too, thats why.  If i unnecessarily hurt someone, they can sue me, and i would have to prove why i hurt them.  Apparently these "rules" and laws don't apply to the downtown county jail deputies.  Granted, theres' is a tough job and there are times when overwhelming force is necessary and prudent, but not every deputy has the skill and restraint to enforce force properly.  If the "ACLU" didn't bring these issues to light, i'm not sure who would.  Most people really don't care if criminals are being abused unfairly, as society has enough to worry about as it is.  And the issues that cause these problems, like overcrowding, continue to be debated by the local "powers that be".  No doubt it is a difficult subject, but people are people (even criminals), and when someone is being abused because the deputy doesn't like the way you look, that's cause for concern.  Good luck "ACLU".....Good Luck !!!!

  Why is it so Important to hire a good Lawyer ?

Because your future depends on it, thats why !!  One of the most difficult aspects of my line of work (bail bonds), believe it or not, has nothing to actually do with BAIL BONDS.  But rather, with the decisions that some of my clients have made thru the years hiring incompetent and non-interested criminal defense attorneys.  Granted, my opinions are more towards felony charges than misdemeanors, but i've seen misdemeanors turn out worse than they actually began with.  I'm so passionate about this because i field at least 1 or 2 calls a month from people i've bailed out of jail who call me to "vent" about the poor communication or performance of the lawyer they have hired.  And once you "set sail" with the attorney you have retained, it is very difficult legally, and financially, to reverse course and go with someone new.  In fact, i know some criminal defense lawyer's who will not get involved with a case once someone has hired a lawyer already.  This is what's formally called a "retainer agreement", meaning you've paid for , and signed contracts with,  a criminal defense lawyer.  I always encourage people to hire a lawyer who works specifically out of the courthouse where your criminal case is being heard ( as relationships are EVERYTHING in the courtroom).  I also suggest you go to the lawyer's office to see how neat and professional they may be.  And lastly, if you call a lawyer and he doesn't return the call by the end of that day, then it's probably a good idea to call someone else.  Trust me !  And if your looking for good bail information, well, look no further.  Your here.   Take Care, Dan.......

  Jackass Star "Steve-O" is a Jackass no more.........Kinda

It has been over 2 years since i first met Stephen Glover, a.k.a Steve-O from Jackass fame ; March of 2008 to be exact.  I bailed him out of the Hollywood Police Department on drug possession and rowdiness charges.  Steve-O, rowdy ??  Anyway, that was the least of his concerns! Steve Glover had serious drug and alcohol dependencies.  It's still hard for me to believe how whacked out he was.  I rarely get emotionally involved with my bail cases, especially celebrity bail, but this guy was different.  Steve-O is truly a good guy with a big heart, and i quickly came to see why SO MANY PEOPLE from his world came to his "rescue" when he was admitted into the Cedars "psych ward".  From that absolute rock bottom place, i watched him begin to get sober and heal himself.  I began to schedule monthly lunches with him to check in on him and encourage his efforts.  Hell, ABC television took notice and rewarded him with a place on the hit show "Dancing with the Stars" !  Fred Astaire, he is not.  A Champion ? That is who Steve-O is.  An absolutely inspiring story that reminds me to encourage people i meet thru bail bonds, or life,  who are struggling with addiction to look at Steve-O as an example of change.  He had become famous for doing outrageous stunts while wasted and high, and when he bottomed out and crashed, he looked me in the eye and said he was going to change for the better and now stay famous for being sober.  I told him he'd become an inspiration to millions if he could do it.   He has.  Way to go Steve-O.   Nice job........

  How long does it take to get out of Jail ?

This has to be one of the most popular questions i receive as a bail bondsman.  And also, one of the hardest to answer.  It all depends on WHERE the person who has been arrested is in custody.  If your at a local police department anywhere in southern california, i can get the defendant out between 20 minutes to 2 hours, all depending on how busy that particular facility is and how "cooperative" the police officers are.  If a defendant has made their way to a county jail, and it doesn't matter if it's San Bernardino County, Orange County, Riverside County, Ventura County or Los Angeles County : the release times from these facilities are much longer.  Anywhere from 3 hours to 24 hours !!   Very big difference indeed.   That is why time and speed are SO CRUCIAL in the arrest process.   Every single police department has a different set of "rules" they use to determine how long a defendant will remain @ their facility before they decide to ship them off to "County", as it is affectionately known.   Whether your a celebrity or a common man or woman, there is little preferential treatment.  Here at Dan's Bail Bonds, we take pride in answering our phones the first time you call us for bail info.  I, Dan Nesser, insure that i immediately find out EXACTLY what is happening regarding the person in custody so we can prevent any problems or delays to occur.  That is why I am known as a professional bail bondsman.  I actually mean it.   No one is ever in a "hurry" to call me for my bail bond services, but if you have to, rest easy, i have 15 years experience.  Remember, time is of the essence !!  Take Care..........Dan Nesser

  Types of Bail Bonds

Most people understand what bail bonds are, but few people realize there are more than one type of bail bond. At Dan's Bail Bonds, we offer a variety of bond options, such as:

  • Criminal Bail Bonds: the type of bail used to release someone who is in custody for committing a crime. The person who posts bail only has to pay 10% of the total bail amount to secure this type of bail bond.
  • Federal Bail Bonds: the type of bail bond used to release someone who is in custody for committing a federal crime.

  Meditation is not a Hard Cell

I recently came across a story highlighting the work of Buddhist Chaplain priest Daniel Buckley.  Mr. Buckley volunteers his time to counsel inmates locked up in Los Angeles' downtown Mens Central Jail.  

Every week he counsels inmates who would like to learn more about his teachings of "focus, concentration and breathing" techniques, all designed to help teach these men how to calm down and gain control of their anger and emotions when they begin to get "upset".  

Now, in my opinion, this is incredible "hands on" work that really gets to the very core of WHY most of these men are criminals and locked up in such a hard and dangerous jail: Anger !!  Anger is mentioned by these men as the primary reason they have committed serious crimes in the first place.  I have personally noticed first hand in my years as a bail bondsman the one common denominator that most people i bail out possess: Anger.  It's at the root of nearly every criminal.  So controlling ones anger means controlling yourself, and that is a powerful revelation to the men who have "gotten it" and now preach about the effectiveness of Chaplain Buckleys class and teachings.  Because trying to "keep your head about you" in a place as dark, depressing and dangerous as the Downtown Mens Jail is awfully tough, and men like Chaplain Buckley, and other volunteers like him can make a big difference for the better.   Kudo's to all who try to make our world a better place.  Kudo's indeed.........

  Just EXACTLY how much does a Bail Bond Cost ?

One of the most common, and important, questions i receive is "Dan, how much does a bail bond REALLY cost"??  It's understandable for the consumer to be confused about this because the bail bond industry is very large and when one begins to do research they are overwhelmed with 5% rates and 4% rates,etc...etc... Well, the truth is a bail bond cost 10% of the bond value.  For example, if the bail has been set at 20,000 dollars, then it will cost you 2,000 to bail that person out.  Period.  Now, there is a legal discounted rate available, and that is 8%.  This 8% rate is given to the consumer if they have A.) hired a private criminal defense attorney or B.) if there is a full-time employed union member engaged in the bail negotiation.  These "rules" are set by the California Dep. of Insurance and they are regulated and ENFORCED.  There have been many stories of unscrupulous and unethical bail agencies charging "low ball" rates, and the courts are no longer tolerating it.  By agreeing to do business with a bail agent who is charging less than the 10% /  8% rate guidelines, you are subjecting your friend or loved one who has already bailed out to possible rearrest inside the courtroom.  It is not uncommon for the judge to ask about these things, and failure to prove you have paid the legal bail bond fee's  can lead to rearrest and the unfortunate scenario of having to bail out AGAIN !!  This is not a conspiracy theory.  These are facts.  So be careful and make certain you have asked all the right questions.  Im available 24 hours a day if you'd like more information.  Sincerely, Dan Nesser

  Cases Sit Idle as Police Hit Overtime Cap

LAPD detectives have recently been told by their supervisors to put their work on hold for days, even weeks at a time, until the county of Los Angeles can get a better grasp on the horrible financial crisis affecting nearly every aspect of life.  I found this story to be troubling for many reasons, particularly because of the inefficiency with which the county "pisses money away" on things that aren't anywhere near as important as detectives investigating rape, murder, burglary, assault and other ugly crimes.  The work of a police detective is pivotal in bringing criminals to justice, so to have their work "put on hold" because of budget issues that could have been avoided with better leadership is most unsettling.   Basically, the County has stopped paying overtime to detectives who are pursuing these cases, and until further notice , are expected to just go home when their shift is up.  Unfortunately, the tax paying general public is the one who suffers because the work these detectives do keeps all of us relatively safe out there on the mean streets of Los Angeles !!  The pursuit of justice is a 24 hour 7 day a week business , and to put these men and women on "payroll suspension" is just another example of how poorly the "leaders" of our local fiscal government operate.  I cannot think of another occupation that is as important as our LAPD detectives, so heres hoping that the "powers that be" wake up and make sure to get these people back to working as much as they deem necessary to bring criminals to justice.

  Impersonating Police Officers a Common Problem

While reading the paper the other day, i came across a story about an Alhambra man who was arrested for impersonating a police officer.  Steven Pritz, 37, was taken into custody after a police officer saw him pull a car over using flashing blue and red lights that can be attached to the dash board or the roof of a vehicle.   These types of lights can easily be bought over the internet and can be used to impersonate a police officer, just like Mr. Pritz did.   This is, believe it or not, a very common problem that has in the past led to murder in very extreme cases.   Most of the time, the people who get a rush off of impersonating a public law enforcement official are just doing it to satisfy they're own emotional issues, rather than looking to inflict harm to those they take advantage of.  The bail for this crime can range anywhere from 20k all the way to 100k, or higher if the situation is extreme.  I often see stories like this on the local, and world, news channels.  It is a global problem and i believe it to be very serious.  Whenever someone is being pulled over and they suspect something is just not right, they should ask for proper identification and never stop in a remote place.  Always try to use common sense if you feel threatened in any manner.   Or just call 911 if all else fails.   Thats what it's there for !!!   Take care.   DN .

  U.S. Consulate employees slain in broad daylight

For the first time in memory, Mexico's drug cartel has targeted U.S. diplomatic personnel and their families in the savage and brutal war for control of the Mexican/U.S. border in Ciudad Juarez.  That section of the border is where a majority of illegal drugs enter the U.S. and where weapons and cash return back to the drug cartel's who "control" the operations.  However, what took place this weekend is unprecedented.  Employees of the U.S. Embassy in Northern Mexico were shot to death in two separate drive-by shootings in broad daylight, and in both cases young babies were in the back seats, left alive.  Even President Obama held a press conference to condemn these cowardly acts.  Mexico doesn't have a bail bond system like here in the States.  It's either "kill, or be killed", and the level of violence taking place between competing gangs and drug cartels is reaching epidemic proportions.   It is no secret that billions of dollars are at stake in these turf wars, and local law enforcement in Mexico is simply no match for the brazen, fearless cartel members who wish to have their drug and weapon routes left open by authorities who are cracking down on their existence.  It remains unclear why these particular people were targeted, and all U.S. employees of the Mexican Consulate have been cleared to return to the States until further notice.  This is an issue that will remain for a long time to come.  Maybe we can bring some of our troops home from Iraq to take control of this mess near the El Paso, Texas/Mexican border ??!!

  Man Apprehends Robbery Suspect in Long Beach

Hello to all.....One of the "best" stories that caught my eye from this past weekend was regarding one David Jones.  Mr. Jones was inside the Farmers and Merchants bank in Long Beach on friday afternoon when he witnessed a man barrel thru the front door with a gun in hand AND STARTED SHOOTING it immediately !!!!!  Now, i don't know about you but i would have shit a brick;  anyhow, Mr. Jones watched in horror as the gunman shot a bank customer in the thigh.  That customer had the nerve to grab the gunman and begin to wrestle with the weapon.  At that exact moment, Mr. Jones decided to intervene.  He immediately grabbed the gunman and threw him to the ground in a strong tussle, which dislodged the gun from the robber's hands.  Unfortunately, another bank employee was shot (not seriously) during the scrum when the weapon discharged again.  However, that was it, as Mr. Jones was able to free the weapon from the gunman's hand and keep him pinned to the ground until authorities arrived.  Needless to say Mr. Jones is a big burly man who used his size to his advantage indeed !!  As it turns out, this robbery suspect is wanted in connection for at least 5 other bank robberies in the Southland and is currently in police custody with a 1,000,000 bail.  See, i guess crime really DOES'NT pay after all..........

  Olympic Hangover

Hello to all.......well, i don't know about you, but i'm still reeling from the United States' chance to win it's first gold medal in hockey in 50 years !!!!!   Unfortunately, we lost to Canada 3-2.   Granted, Canada is where the sport of hockey originated, so it's not like we lost to Kazahkstan or something.   It just frustrates me that the U.S. had such a "golden" opportunity to make olympic, and sporting, history.......and we lost it.   Literally, in an overtime that was as tense and excitement filled as any moment in sporting news memory.   I have watched with pride as the U.S. , once world hockey doormats, rise up and become a force to be reckoned with on the international stage.   We played the entire olympic games with a vigor and passion that showed me that hockey in this country is here to stay !!!   For years now (or since Wayne Gretzky retired) there has been "talk" that the sport of hockey is not "making it" here in southern california and beyond.  And, to some degree, thats been true.  In fact, ESPN, the nations most watched sports news network even let the t.v. rights to hockey slip away to a competitor without a fight 4 years ago.   However, now ESPN is in talks to bring it back to their network and help make it one of America's most watched sports.  And deservedly so, because 20 million people watched the gold medal game on Sunday, and i bet a couple of them were ESPN executives.     Stay out of trouble, but call me if you don't...........Dan

Hello to all.......One of the most frustrating things to come out of our "broken" legal system is the early release of inmates (criminals) from custody.   Of all the various stories that have been reported on regarding this very important issue, the root of it all is money !  Hey, isn't it usually money ?   Money is what the court system, like the rest of the world, needs.  And by releasing inmates who should remain in custody;  because they have proven to be threats to society, the jails can arrest more people and try to generate more income.   It's unsettling to many taxpayers that criminals who have committed serious crimes are sometimes back on the street within days of their arrests,  when required sentencing of these criminals sometimes calls for up to 1-2 years in prison.  This gives lawbreakers the feeling that they can go right ahead and commit more crimes because they wont be harshly penalized.   Lawmakers across the Golden State, including Attorney General Jerry Brown, have conflicting opinions and enforcement of this frustrating practice.   Last week, the Orang County sheriff's deputies union tried to file a court injunction to halt early releases at their county jail.   As reported in the Los Angeles times by reporters Andrew Blankstein and Richard Winton,  Superior Court Judge Steven Perk blocked that legal request and set a future court date to talk about it further.  Yippee.....So the early releases will continue and the message will continue to be confusing and gridlocked, kind of like Washington D.C.    Some days i wish we implemented the "eye for an eye" rule of law.   Steal from someone, lose your pinkey finger, and so forth and so on.....   Medical Marijuana Issues Persist !!!

Good Day to all............Well,  the "cat and mouse" game taking place between medical marijuana dispensaries and local government agencies took another dramatic turn this past Thursday here in Los Angeles.  In an excellent article appearing in the Los Angeles Times today, reporter John Hoeffel writes of city prosecutors suing 3 collectives and moving to evict 18 others in an aggressive movement to rid the city of "pot shop owners" who are masquerading as drug-dealers.  The exploitation of these operations has been a problem since the State first began issuing these dispensary licenses in 1995.  However, with the tough economic climate, these businesses have become increasingly "shady", to say the least.   Of the 21 dispensaries mentioned as being targeted by LAPD, all were reported on by local citizens who complained of apparent and blatant violations.  A very powerful reminder of community indeed !!!!         I personally don't have a problem with a few of these dispensaries operating around L.A.,  as long as they're professional and properly run.   But to see the city issue 500 of these licenses and then wonder why they have so many rogue operations is typical and sooooo big government. I encourage all to read Mr. Hoeffel's article on page AA3 of todays L.A. Times.

  Guns for Gift Cards is Ingenious

Hello All........One of the more "touching" stories to come out of the Holiday Season was the "guns for gift card" idea initiated by the Los Angeles Police Department years ago.  The idea is simple:  bring in a gun, ANY GUN, and you will receive a retail or supermarket gift card in various denominations.   The event is usually held in Compton or South Central L.A. to encourage people to get rid of those needless weapons for much needed gift cards that can be used at participating grocers and various retail outlets throughout the Southland.   One man in particular exchanged 58 guns for thousands of dollars in gift cards.   And no one need to fear arrest or warrant checks, as this is a "don't ask don't tell" event !!  So no matter who you are or what your background may be, all you need to do is bring in a weapon to receive your gift card.   The more guns you bring in, the more money you get.   I think this is an outstanding idea that should be implemented every month in every region of the city of Los Angeles, not just the Holidays !!  By the way, homicides were down in Compton in 2009..........Stay out of trouble, Dan.............

  Dans Bail Bonds launches exciting new blog to save the world !!

Hello World !!!   My name is Dan Nesser and i am the owner of Dans Bail Bonds, located here in the great city of Los Angeles, California.   I have been a licensed bail agent for 12 years and very much enjoy my line of work.   However, i was resistant to blog for some time now because i've  felt overwhelmed by the vast landscape that is the world wide web !!  But my feelings have changed.  I now feel compelled to blog about the bail bond business and the criminal defense industry and lawyers and courts and ALL THINGS LEGAL because there is simply so much BAD INFORMATION out there.  And i just feel that maybe, just maybe, one person might come across my GOOD INFORMATION, and i can then assist them in a positive way and help make a difference in someones life.   And to be honest, i have been trying to make a positive difference all my life.  It now makes sense to me that the internet is EXACTLY the place where i can maybe make more of an impact.   

Ever since i became involved in the bail bond industry as a bail bondsman, i have marveled at how people react to me when they find out what i do for a living.  9 out of 10 people really have little or no knowledge of HOW A BAIL BOND WORKS and how much they cost and what the legal responsibilities are, etc...  This remains today as the biggest obstacle i face when assisting people who are in search of a bail bond for their friend or loved one : trying to educate properly !!    There's just SO MUCH to choose from when one searches for a bail bondsman, and half the people in the business have little, or no, morals or ethics.  The reason this troubles me is because these "people" prey on the ignorance of the consumer to enrich themselves at the expense of your legal and civil rights.    Bail Bonds are expensive.  The "premium" , better known as 10%, is how i make my living.  That is the rate i can charge according to California law for a criminal bail bond.  This can be quite costly when you consider that the average bail bond written in California is 25,000 thousand dollars !!    And the contracts one must sign with a licensed bail bondsman contain LOTS AND LOTS of rules and provisions, and if they are not fully understood by YOU THE CONSUMER, a lot of people will take advantage of you and the person in custody.  Now, i am not a conspiracy theorist , but actually a REALIST !!    And thru the years i have learned firsthand how unscrupulous and unethical this business can be.   I will be citing stories and sources from the Los Angeles Times and The New York Times, as well as many other magazines and real experts in all things legal, to emphasize and illuminate my various viewpoints and observations.   All in the hopes that i can make a positive difference when helping to educate and inform those in search of bail bonds, legal advice and criminal defense  information.   Today, February 9th, 2010 marks the initial introduction of my blog.  As i move forward, it will be my duty to bring truth, stories, knowledge, passion and information to my blog that reflect the "state of the crime and legal industry".......I thank you for your time today and i hope you find an interest in my opinions.  I am here to help !!   To learn more about me, one may go to : DansBailBonds.Com and my personal e-mail is sirnessbonds@hotmail.com.  I look forward to any inquires or questions.   And, of course, call me directly @ 213-237-9910, as i am available 24/7/365.    Sincerely, Dan Nesser
