There are difficult times in people’s life that result in arrest, and find themselves in police custody. It’s also called unsecured appearance bond or Release on Own Recognizance (O.R.). This usually cited for lesser offences. Typically the court will set a small monetary amount, the defendant is released upon a written statement that she or he will appear in court.
2) Citation Release or Cite Out
A Citation Release procedure involves the issuance of the officer to the detainee that he or she must appear in appointed court date. Cite Out usually occurs immediately after the person’ arrest and no financial security is needed.
3) Property Bond
The accused or a person acting in behalf of the detainee pledged a property that must be 150% or twice of the bail amount, such as real estate. If the accused failed to appear in court, judge will foreclose the property.
4) Cash Bail
Typically for the accused who posted a large flight risk or have had failed appearance in previous court date. The individual must post the full amount of the bail in either cash or check. After the case has been resolved, the entire amount is then refunded to the defendant.
5) Bail Bond/Surety Bond
A third party, such as a licensed bail bond company, will take sole financial responsibility of the detainee and also assure the accused will return to court for trail. Bail bond companies usually charge a premium and often requires collateral. In many states, including California, the cost of a bail bond service is typically 10% of the total bail, and is non-refundable.
